There are many different types of sex offenses in Washington, and one of the most serious is the crime of rape. To be classified as rape, forcible sexual intercourse must have occurred; Washington State defines sexual intercourse as essentially any oral, vaginal, or anal penetration by any object.
Rape 1st Degree: This Class A Felony occurs when an individual forces sexual intercourse, and also acts in any of the following ways:
- Uses, or threatens to use a weapon
- Kidnaps the victim
- Causes serious physical injury to the victim
- Enters a car or building to gain access to the victim
Rape 2nd Degree: This Class A felony includes any forced sexual intercourse in which the perpetrator used forcible compulsion, and victim is unable to give consent, such as a person with a developmental disability, physical handicap, or mental incapacitation.
Rape 3rd Degree: The offense will be a Class C felony 3rd degree rape charge if the crime does not meet the qualifications for a 1st or 2nd degree charge, and meets both of the following conditions:
- The victim expressed a lack of consent either verbally, or through their conduct
- The victim is unable to give consent, such as a physically helpless or disabled individual.
Indecent Liberties: If the perpetrator forces sexual contact, rather than sexual intercourse, the offense may be Indecent Liberties if the following are true:
- Forcible compulsion was used to commit the crime
- The victim is incapable of offering their consent.
